β Everything You Need to Know
Buying property in India from Canada is completely legal and straightforward β when done correctly. Here’s what the law says.
Who Can Buy?
Indian Passport (NRI) or OCI cardholders can purchase residential & commercial property in India without RBI permission. PIOs with valid OCI cards are fully eligible. Agricultural land is prohibited.
Payment Rules
All payments must flow through NRE, NRO, or FCNR accounts held with Indian banks. Direct wire transfer from your Canadian bank account to a builder is not permitted under FEMA regulations.
Power of Attorney (POA)
If you can’t visit India, a registered POA to a family member or our trusted legal partner allows them to sign documents, complete registration, and manage the entire process on your behalf.
Repatriation of Funds
Up to 2 properties can have sale proceeds repatriated to Canada. Proceeds go to NRE account β Canadian bank. FEMA allows full repatriation if purchase was through NRE funds.
Tax in India
Long-term capital gains (2+ years) taxed at 12.5% without indexation. Short-term at slab rate. Rental income taxed after standard deduction. TDS applicable β your CA can file for refund if excess deducted.
Tax in Canada (FBAR/CRA)
CRA requires you to declare foreign property over CAD $100,000 on T1135. Rental income must be declared β but India-Canada DTAA prevents double taxation. Always consult a cross-border CPA.
